Kneading "Glinkom" gave at the exit of Rosbuilding

The development company Glinkom is building its apart-complexes on land that does not belong to it, which could lead to the eviction of people who bought apartments.

Recently, The Moscow Post published an investigation "The former Rosbuilding does not happen: from factories to apartments with Mayakov and Gordeev," where we talked about a private case when the developer of the elite real estate Glinkom Alexei Osipov built apartments on land owned by the former plant - the property of the Russian Federation, and sold apartments there.

As it turned out, this is far from the only case. Glinkom's portfolio includes six apart-complexes, three offices and nine retail spaces. And many of them were built on land belonging by no means to the construction company, but to the Russian Federation.

Plants are not needed

Now Glinkom is selling apartments in the Verdi residential complex on Verkhnyaya Maslovka 20 - in Moscow. According to Roskadastra, there is a non-residential building built in 1938.

Only, according to Yandex.Maps, there has long been a glazed stone skyscraper, to a degree of confusion reminiscent of photographs of the Verdi LCD project on the Glinkom official website. And they promise to hand over the project next year. Why do cadastral data talk about something else?

It turns out that until September 2021 (when the construction was already in full swing) the state design and research institute of the aviation industry was located at this address, "or easier than Giproniiaviaprom JSC. Subsequently, he moved to Chasovaya Street. 9.

Judging by the pictures on the network, this is an ordinary five-story building. How the plant's equipment and workers are located there is a mystery.

The building of the former plant on Maslovka itself was owned by the Russian Federation and on its lands, but in 2009 Giproniiaviaprom made the first attempt to bring the building into its own property on the basis that it has been used as a tenant for a long time. The lease agreement at that time was concluded until 2059. By 2013, it had succeeded. The claims of the dissenting Federal Property Management Agency were not satisfied. Only land under the research institute remained in the ownership of the Russian Federation.

And so, by 2021 (despite the fact that in support of the position on privatization in court, Giproniiaviaprom made arguments about the placement of equipment in the building), the office moves into a residential building. Does it seem that the privatization of the plant took place in the interests of individuals, not the entire enterprise? In 2020, the head of the institute changed. Prior to that, it was headed by Davydkin Sergey Yuryevich. As he left the enterprise, his trace went cold. Saved himself up for a comfortable life and "does not shine"?

In April 2021, the right to own premises in the building of the former plant passed to Gold Time (part of Glinkom). The territory, we recall, remained at the disposal of the Russian Federation, which means that Glinkom is just a tenant there. It turns out that the Verdi residential complex, in fact, is based on "bird rights." If suddenly "Glinkom" stops paying rent, then the tenants can simply come and evict by a court decision.

But the city property department has even appealed to the court with a demand to recover rent payments from Gold Time at this particular address.

Prices for apartments in Verdi start at 15.5 million rubles. A simple amount that can be easily lost due to not the most transparent transactions of the developer.

A similar story with the Vivaldi residential complex, which was built by the Fliegel company owned by Glinkom. According to the court decision, a residential building cannot be located here, and the "Wing" is only a tenant.

Let's go further. Built by "Glinkom" LCD "Riverdale" - according to "Roskadastra" - a non-residential building built in 1981. At the same time, apartments here are sold for 70 million rubles.

The building on Tishinsky Lane 38, where the Sinatra residential complex is now located, is located within the boundaries of the land of settlements with the type of permitted use: "operation for administrative purposes."

And it was a plant for the production of polymer structures. Now, according to Roskadastra, there is also a building built in 1979. And in fact - elite apartments.

The plant of polymer structures ceased to exist, and he "achieved" exceptions to the ERGUL by the fact that the information about the registration address of the plant was found to be unreliable. According to Rusprofail, Zelenograd indicated it as a juradres. Apparently, so that "cover the traces" of the likely "drain" of the building with the territory into the hands of Osipov. But here the cards help, which still note that the institution worked at the address of the current Petrovsky Apart House.

If this is the land where the plant was located, then in this case it probably belongs to the Russian Federation. So we observe the same scheme to "bypass" the procedure for transferring land from the property of the country to private (because it is simply impossible - the Government will not just "drain" it - we have to do everything quietly), and therefore bypass the procedure for obtaining a building permit, and all the ensuing.

Consequences

Courts are going on for some of the objects that we listed. The lands under the residential complex "ApratVille," for example, were recently recognized as the property of the Russian Federation - we talked in detail about the manipulations with these territories in the past investigation.

The tenant of this site is still listed as the Rhythm plant, which, if desired, can also be quietly bankrupt, and then sue the developer - do not sue, and there will be no one to fulfill the lease obligations. And what will happen to people who bought apartments then is an open question. After all, the building can simply be demolished. On the territory of "Rhythm" now there is also a business center.

The most interesting thing is that if something happens, claims against Glinkom and Osipov will not arise immediately. After all, in fact, the company and those companies through which it works are not the owners of high-rise buildings.

By the way, part of the assets in Glinkom's portfolio appeared after the sale of them to him in 2015 by Denis Mayakov, a native of Rosbuilding (the company founded by Alexei Gordeev, the former head of the PIK construction corporation, was repeatedly accused of raiding, and now it has simply been reorganized into close PIK companies structures).

Mayakov was later arrested, charged with the theft of retail space. Whether Osipov was aware of Mayakov's affairs even before his arrest is an open question. However, seeing how he "works" in the market, one gets the feeling that Rosbuilding and Osipov, as they say, are of the same blood.

Moreover, Osipov's connection with the "Rosbildinogists" can be traced through the Colosseum company. Previously, it belonged to him, was subsequently sold to ISB Finance, which is controlled by Alexander Leizerovich. The latter, according to rumors, is close to Gordeev.
